連帯保証人を立てる際の注意点です。（個人の根保証）

 

２０２０年４月１日～法改正となりました

民法第465条の2第2項
「個人根保証契約は、前項に規定する極度額を定めなければ、その効力を生じない。」（※法人を除く）

 

極度額とはなんぞや。って事なのですが

上限額のことです。

 

借主様の滞納額、違約金等

以前までは上限なく、青天井で連帯保証人となった保証人様が保証しなくてならなかった。

 

のですが、現在は上限額が設定されるようになりました。

 

賃貸借契約は２年契約ごとで結ぶため、

賃料の１２～２４ヶ月分が多いようです。

 

２０２０年４月１日以降改正のため、それ以前の契約については

無効となります。

 

法律は随時変わりますが、お客様や保証人様保護に向けて良い法改正の一つですね。

逆に、賃貸管理会社様は契約書類作成時には注意が必要です
